- What is it?
The Homeowners Protection Act
Right now, there is a practice called “eminent domain” which allows local and state government to take and use private property for public projects such as housing, school or roads, if the property has been condemned, abandoned or damaged. Proposition 99 would make it more difficult for government to exercise “eminent domain” for an owner-occupied residence, but does not erase rent control or make it more difficult to exercise eminent domain for affordable housing, etc.
- What do supporters of Proposition 99 say?
- Cancels out Proposition 98 if Proposition 99 passes with more votes
- Prohibits the taking of homes for transfer ownership to another private
party
- Preserves state or local rent control laws or ordinances
- Preserves laws that protect tenants and uphold affordable housing requirements
- Upholds current limitations for acquisitions of private property for
public works projects such as schools, roads, and public water projects, etc
- Preserves environmental protection laws and protections to public health
and safety

- No protections for businesses, farmland, places of worship
- Does not change the current definition of just compensation
- Allows private property to be taken and transferred to another private
owner
- Contains a provision intended to deprive Californians of additional
property rights protections, even if those additional protections are approved by a majority of California voters
- Does not include provisions to protect a property owner from government's
ability to regulate the price he or she can sell or lease real property
- Contains a far broader exception allowing the use of eminent domain
